If you’ve already determined he should get the death penalty, why go through the motions of a trial and why not just shoot the guy? He has already been tortured more than 80 times. You see, that’s why I don’t believe in jury trials when it comes to terrorism cases. American juries take upon themselves to fight the "War on Terror." Justice is not served. US courts look like kangaroo courts.

Btw Obama apparently didn’t make the descision. His attorney General did, with the help of his wife and brother who is a retirerd port authority worker. So the attorney General called Obama why he was on his jet to Asia and Obama said he doesnt care either way, its not his job.

I think there is enough evidence against this guy that even the illegal and despicable acts against him while imprisoned (the evidence from which will not be, and should not be accepted in court, since it was not only illegally obtained, it is unreliable) will not get in the way of a conviction. It is best that he get a fair trial and convicted in an unambiguous way.

I understand our legal process. I don’t think the president would be to blame for a technicality…such a thing could happen in military or civil proceedings.

He won’t get off on a technicality. Can you name a mass murderer who ever got off on a technicality? Don’t say OJ, that wasn’t a technicality.

Because the attack they planned took place in a foreign country and was directed only at a military target. If the republicans wanted to try KSM by military tribunal they should have tried him instead of playing around for 5+ years.

The only way we can be a really free country is if we have fair trials. If he gets off, which isnt going to happen, then we shouldnt have screwed up in the first place. Its our fault not his. Well just have to set him loose and stay on him like flies on what he is.

Were you this worried about the fiasco that was going on at Guantanomo? Apparently part of the reason so few people were tried is that the US did such a piss poor job of record keeping and preparing to bring cases against the so called "terrorists". You are absolutely right, and I think Obama and his cronies are going to see to it that they do get off on some reason. But if they do, there is one darn good thing that can be done, and that is IMPEACH OBAMA, cause he had the authority to not let it happen and he is pushing for it to be done in NY, and really did not have the balls to face the teleprompter and tell us, he sent out his cronie and had him do it, and it is not his job to do it, it is OBAMA’s job . Obama purposely did not do it, like the coward he really is. If them terrorist get off, I know Obama will be Impeached. Watch and see. Obama is not doing his job period, he has his Czar mob, they only answer to him and do it for him.

Since we do not marandize enemy combatants, much of the evidence will be thrown out. He will get by with it. There will have to be muslims on the jury in order for it to be jury of his peers. You don’t really think they can be imparital do you? Top that off with violent threats that will lodged at the jurors, yeah, he’ll get off, sue the city and retire in Bill Ayers’ neighborhood.

Yes, I would. The likelihood of screw ups is the same no matter what court he’s tried in. And unless someone really went overboard or is completely incompetent, the likelihood of acquittal or vacating of conviction due to a technicality is very, very small. If, for some reason, his conviction is vacated, he won’t be acquitted of the charges and released. The prosecution will make the changes recommended in the court decision and try him again.
The location where the crime takes place is where the charges are brought and where the trial occurs. I’m sure that, considering the publicity surrounding 9/11, the very first thing the defense will request will be a change of venue (location). Good luck with that. No matter where the trial is held it’s going to take months to impanel an impartial jury – if the defense opts for a jury trial.
The Cole was a military target attacked overseas by non-citizens who killed military personnel. It’s an entirely military matter. The WTC attack was committed by non-citizens against an American civilian target and killed American civilians. It’s a civilian matter.
(Why are you worrying about legal technicalities now? The greatest problem that the old sheikh is going to have is living through the trial – unless you think New Yorkers can’t match the ferocity of Al Qaida. I think some of them will be doing everything they can to get to him.)
